Introduction: By booking a rental with Up-lease, you agree to the following terms and conditions. By accessing Up-lease sites, making a reservation, and/or any services offered by Up-lease, you represent and warrant that you are legally authorized to enter these terms and by doing so you have read, understood and agree to be bound by terms outlined.

Booking and Payment: To secure a reservation, guests must provide accurate and complete information during the booking process. A deposit or full payment may be required to confirm the reservation. The payment schedule will be outlined during the booking process. Payment methods accepted will be specified during the booking process. If a deposit is required, the remaining balance must be paid by the due date outlined in the confirmation email or rental agreement. Upon successful booking, guests will receive a confirmation email containing reservation details and payment receipt. It is your responsibility to review the confirmation email carefully and contact Up-lease immediately if any discrepancies are found. Failure to make the full payment by the due date may result in the cancellation of the reservation.

Rental Agreement: The rental agreement will outline the rental period, occupancy limits, property rules, and other important terms. Rental agreements may vary among properties and/or rental type. It is your responsibility to review and adhere to this agreement. Guests will be required to sign a rental agreement before the reservation is considered final. The signed rental agreement must be returned within the specified time frame to secure the reservation.

Cancellation and Refunds: Cancellation policies vary depending on the property. Cancellation requests must be submitted in writing via email or through Up-lease's booking platform. The date and time of the cancellation request will be used to determine eligibility for a refund based on the cancellation policy. Refunds, if applicable, will be based on the cancellation policy in effect at the time of booking. All refunds will be processed back to the original payment method used during booking. Processing times for refunds may vary depending on the payment provider and may take up to 10 business days. Guests may request to change their booking dates, subject to availability and approval by Up-lease. Changing booking dates may be subject to an administrative fee. In rare cases, Up-lease may need to cancel a booking due to unexpected circumstances or property-related issues. If Up-lease cancels a booking, guests will receive a full refund, and efforts will be made to assist in finding alternative accommodations. By making a reservation with Up-lease, you acknowledge that you have read, understood, and agreed to our cancellation policy. This policy helps us maintain fair and consistent practices while providing the best possible service to all guests.

Force Majeure: In the event of unforeseen circumstances, such as natural disasters, pandemics, or government-imposed travel restrictions, Up-lease may offer alternative booking dates or issue a full refund. Guests must provide valid documentation to support force majeure-related cancellations.

Check-In and Check-Out: Check-in and check-out times will be provided in your rental confirmation. Please adhere to these times to facilitate smooth transitions for other guests.

Occupancy Limits: The maximum occupancy for each rental is specified in the rental agreement. Exceeding this limit may result in additional fees or termination of the rental agreement.

Property Use: The rental is intended for temporary travel use only. Commercial activities or events without prior consent are prohibited.

Care of Property: Guests are expected to treat the vacation rental with care and respect during their stay. Any damages beyond normal wear and tear may result in repair charges. Guests should use all appliances, furniture, amenities and fixtures in the property as intended and with care. Do not move or tamper with fixed installations or appliances without permission. Guests must report any damages or issues with the property to the vacation rental company or property owner promptly. Failure to report damages or comply with care of property terms or any term herein may result in additional charges, deductions from the security deposit, or termination of the rental agreement. These guidelines help to ensure the proper care and maintenance of the property for all guests.

Rental Rules: Guests must comply with all house rules provided by Up-lease and/or the property owner or manager. This includes noise restrictions, use of amenities, specific guidelines for the rental unit, property, and adherence to local laws. Guests are required to maintain the cleanliness of the property during their stay. A cleaning fee may be included in the reservation, but guests are still expected to leave the property in a reasonably clean condition. Guests must properly dispose of trash and recycling according to the guidelines provided by Up-lease or property owner/management. Prohibitive activities include smoking indoors (if smoking is not allowed), subletting or assigning the rental to others, hosting parties or events without prior consent, and ussing the property for illegal activities.

Pest Control: Guests must promptly report any pest infestations to Up-lease or property owner/management. Guests should not attempt to resolve pest issues themselves.

Pets: If the property allows pets, guests must follow the pet policy and clean up after their pets. Guests are responsible for any damages caused by their pets. Violation of this policy may result in additional cleaning fees and damages fees.

Security Deposit: A security deposit may be required upon booking. It will be held to cover any damages or violations of the rental agreement.

Travel Insurance: We recommend obtaining comprehensive travel insurance to protect your rental investment against unforeseen events, cancellations, or travel interruptions.

Security: While Up-lease and the property owner and/or management takes measures to ensure the security of the vacation rentals, guests are responsible for securing their belongings and the property during their stay.

14. Property Access: Up-lease or its representatives may access the property for maintenance or inspection purposes with reasonable notice.

Complaints and Issues: If you encounter any issues during your stay, please report them immediately to Up-lease and/or property maanagement for resolution.

Communication: All communication regarding the reservation must be conducted through the provided contact channels. Up-lease will communicate important updates or changes through the email provided during booking.

Third-Party Services: Up-lease may provide information or links to third-party services (e.g., tours, activities, transportation) for guest convenience. Guests are advised to use third-party services at their own risk, and up-lease nor the property owner and/or management is liable for any issues related to these services.

Liability: Up-lease takes reasonable care to provide accurate property descriptions and ensure that the vacation rentals are well-maintained. However, up-lease is not liable for any inaccuracies in property descriptions or for any issues arising during the stay. Guests are responsible for their personal belongings during their stay at the vacation rental property. Up-lease, property owner and/or management are not responsible for any loss, theft, or damage to guest belongings. Guests are responsible for ensuring the security of the property during their stay. Up-lease, property owner and/or management are not responsible for any personal injuries, accidents, or losses incurred during your stay. Guests are advised to take necessary precautions and use amenities and facilities at their own risk. Up-lease acts as an intermediary between guests and property owners/managers. Up-lease is not liable for any actions or omissions of property owners/managers.

Indemnification: Guests agree to indemnify and hold Up-lease the property owner and its representatives harmless from any claims, losses, or damages arising from their use of the rental.

Governing Law: Any disputes arising from this agreement will be governed by the laws of the the state, city and county of the rental property. Any legal action shall be brought before the appropriate courts of this jurisdiction. To the extent permitted by law, Up-lease's liability for any claim, whether in contract, tort, or otherwise, is limited to the total amount paid by the guest for the rental.

Modifications: Up-lease reserves the right to modify these terms and conditions at any time. Updated terms will be communicated to guests and will apply to future bookings.

By booking a rental with Up-lease, you acknowledge that you have read, understood, and agreed to these terms and conditions. These terms help clarify the responsibilities of the Up-lease, property owners/management and the guests, ensuring a safe and enjoyable experience for all parties involved. Enjoy your stay!
